On Aug. 13, USCIS changed the filing location for Form I-829, Petition by Entrepreneur to Remove Conditions on Permanent Resident Status. This form was previously filed at the California Service Center. Now, petitioners must send Form I-829 to a USCIS Lockbox facility.

 

However, the Immigrant Investor Program Office continues to be the adjudicating office. When filing at a Lockbox facility, petitioners have the option to pay the fee with a money order, personal check, cashier’s check, or credit card. Please follow the Where to File and Filing Fee directions on the I-829 page.

Agency Creates Avenue for American Workers to Report Abuse

WASHINGTON – U.S. Citizenship and Immigration Services (USCIS) today announced multiple measures to further deter and detect H-1B visa fraud and abuse. The H-1B visa program should help U.S. companies recruit highly-skilled foreign nationals when there is a shortage of qualified workers in the country. Yet, too many American workers who are as qualified, willing, and deserving to work in these fields have been ignored or unfairly disadvantaged. Protecting American workers by combating fraud in our employment-based immigration programs is a priority for USCIS.

Beginning today, USCIS will take a more targeted approach when making site visits across the country to H-1B petitioners and the worksites of H-1B employees. USCIS will focus on:

  • Cases where USCIS cannot validate the employer’s basic business information through commercially available data;
  • H-1B-dependent employers (those who have a high ratio of H-1B workers as compared to U.S. workers, as defined by statute); and
  • Employers petitioning for H-1B workers who work off-site at another company or organization’s location.

Targeted site visits will allow USCIS to focus resources where fraud and abuse of the H-1B program may be more likely to occur, and determine whether H-1B dependent employers are evading their obligation to make a good faith effort to recruit U.S. workers. USCIS will continue random and unannounced visits nationwide. These site visits are not meant to target nonimmigrant employees for any kind of criminal or administrative action but rather to identify employers who are abusing the system.

Employers who abuse the H-1B visa program negatively affect U.S. workers, decreasing wages and job opportunities as they import more foreign workers. To further deter and detect abuse, USCIS has established an email address which will allow individuals (including both American workers and H-1B workers who suspect they or others may be the victim of H-1B fraud or abuse) to submit tips, alleged violations and other relevant information about potential H-1B fraud or abuse. Information submitted to the email address will be used for investigations and referrals to law enforcement agencies for potential prosecution.

Existing H-1B Fraud Measures

Since 2009, USCIS has conducted random administrative site visits to ensure that employers and foreign workers are complying with requirements of the H-1B nonimmigrant classification. USCIS refers many cases of suspected fraud or abuse to U.S. Immigration and Customs Enforcement (ICE) for further investigation.

Additionally, individuals can report allegations of employer fraud or abuse by submitting Form WH-4 to the Department of Labor’s (DOL) Wage and Hour Division or by completing ICE’s HSI Tip Form.

USCIS Announces Citizenship and Assimilation Grant Opportunities

Fee-funded grants will support citizenship preparation services for lawful permanent residents

WASHINGTON—U.S. Citizenship and Immigration Services (USCIS) announced today it is now accepting applications for two funding opportunities under the Citizenship and Assimilation Grant Program that will provide up to $10 million in grants for citizenship preparation programs in communities across the country.

These competitive grant opportunities are for organizations that prepare lawful permanent residents for naturalization and promote civic assimilation through increased knowledge of English, U.S. history and civics.

USCIS seeks to expand availability of high-quality citizenship preparation services throughout the country with these two grant opportunities:

  • Citizenship Instruction and Naturalization Application Services. This grant opportunity will fund up to 36 organizations that offer both citizenship instruction and naturalization application services to lawful permanent residents. Applications are due by Aug. 8, 2018.
  • The Refugee and Asylee Assimilation Program. This grant opportunity will fund up to four organizations to provide individualized services to lawful permanent residents who entered the United States under the U.S. Refugee Admissions Program or were granted asylum. These services will help them to obtain the skills and knowledge required for successful citizenship and to foster a sense of belonging and attachment to the United States. This grant strives to promote long term civic assimilation of those lawful permanent residents who have identified naturalization as a goal, yet may need additional information, instruction and services to attain it. Applications are due by Aug. 15, 2018.

USCIS will take into account various program and organizational factors, including past grantee performance and whether an applicant and any sub-awardees are enrolled in E-Verify, when making final award decisions.

USCIS expects to announce award recipients in September.

Since 2009, USCIS has awarded approximately $73 million through 353 grants to immigrant-serving organizations. These organizations have provided citizenship preparation services to more than 200,000 lawful permanent residents in 37 states and the District of Columbia. The funding of these grant opportunities is supported by fee funds.

 ICE delivers more than 5,200 I-9 audit notices to businesses across the US in 2-phase nationwide operation

WASHINGTON — U.S. Immigration and Customs Enforcement’s (ICE) Homeland Security Investigations (HSI) announced Tuesday the results of a two-phase nationwide operation in which I-9 audit notices were served to more than 5,200 businesses around the country since January. A notice of inspection (NOI) informs business owners that ICE is going to audit their hiring records to determine whether they are complying with existing law.

From July 16 to 20, the second phase of the operation, HSI served 2,738 NOIs and made 32 arrests. During the first phase of the operation, Jan. 29 to March 30, HSI served 2,540 NOIs and made 61 arrests.

“This is not a victimless crime,” said Derek N. Benner, Acting Executive Associate Director for HSI. “Unauthorized workers often use stolen identities of legal U.S. workers, which can significantly impact the identity theft victim’s credit, medical records and other aspects of their everyday life.”

While the agency routinely conducts worksite investigations to uphold federal law, HSI is currently carrying out its commitment to increase the number of I-9 audits in an effort to create a culture of compliance among employers, according to Benner.

HSI’s worksite enforcement strategy focuses on the criminal prosecution of employers who knowingly break the law, and the use of I-9 audits and civil fines to encourage compliance with the law. HSI’s worksite enforcement investigators help combat worker exploitation, illegal wages, child labor and other illegal practices.

HSI’s worksite enforcement investigations often involve additional criminal activity, such as alien smuggling, human trafficking, money laundering, document fraud, worker exploitation and/or substandard wage and working conditions.

Earlier this month, a U.S. District Court judge issued a preliminary injunction of the portion of California AB 450 preventing private employers from voluntarily cooperating with federal immigration officials conducting worksite enforcement operations. The U.S. Department of Justice, in March 2018, filed a preemption lawsuit to stop California from interfering with federal immigration authorities, including the imposition of fines against employers ranging from $2000 to $10,000 for failure to comply with AB 450. The court found the law discriminates against California employers who wish to cooperate with immigration officials enforcing the 1986 Immigration Reform and Control Act (IRCA), which requires employers to verify the identity and work eligibility of individuals they hire.

ICE is the federal agency responsible for upholding the laws established by IRCA. These laws help protect jobs for U.S. citizens and others who are lawfully employed, eliminate unfair competitive advantages for companies that hire an illegal workforce, and strengthen public safety and national security.

Under federal law, employers are required to verify the identity and employment eligibility of all individuals they hire, and to document that information using the Employment Eligibility Verification Form I-9. ICE uses the I-9 inspection program to promote compliance with the law, part of a comprehensive strategy to address and deter illegal employment. Inspections are one of the most powerful tools the federal government uses to ensure that businesses are complying with U.S. employment laws.

After receiving the NOIs, employers are required to produce their company’s I-9s within three business days, after which ICE will conduct an inspection for compliance. If employers are not in compliance with the law, an I-9 inspection of their business will likely result in civil fines and could lay the groundwork for criminal prosecution if they are knowingly violating the law. All workers encountered during these investigations who are unauthorized to remain in the United States are subject to administrative arrest and removal from the country.

Failure to follow the law can result in criminal and civil penalties. In FY17, businesses were ordered to pay $97.6 million in judicial forfeitures, fines and restitution, and $7.8 million in civil fines, including one company whose financial penalties represented the largest payment ever levied in an immigration case.

“Employers need to understand that the integrity of their employment records is just as important to the federal government as the integrity of their tax files and banking records. All industries, regardless of size, location and type are expected to comply with the law,” Benner said. “Worksite enforcement protects jobs for U.S. citizens and others who are lawfully employed, eliminates unfair competitive advantages for companies that hire an illegal workforce, and strengthen public safety and national security.”

HSI uses a three-pronged approach to worksite enforcement: compliance, from I-9 inspections, civil fines and referrals for debarment; enforcement, through the criminal arrest of employers and administrative arrest of unauthorized workers; and outreach, through the ICE Mutual Agreement between Government and Employers, or IMAGE program, to instill a culture of compliance and accountability.

From Oct. 1, 2017, through July 20, 2018, HSI opened 6,093 worksite investigations and made 675 criminal and 984 administrative worksite-related arrests, respectively. In fiscal year 2017 – October 2016 to September 2017 – HSI opened 1,716 worksite investigations; initiated 1,360 I-9 audits; and made 139 criminal arrests and 172 administrative arrests related to worksite enforcement.

USCIS Updates Notice to Appear Policy Guidance to Support DHS Enforcement Priorities

WASHINGTON — U.S. Citizenship and Immigration Services issued updated guidance (PDF, 139 KB) today that aligns its policy for issuing Form I-862, Notice to Appear, with the immigration enforcement priorities of the Department of Homeland Security.

A Notice to Appear (NTA) is a document given to an alien that instructs them to appear before an immigration judge on a certain date. The issuance of an NTA commences removal proceedings against the alien. Under the new guidance, USCIS officers will now issue an NTA for a wider range of cases where the individual is removable and there is evidence of fraud, criminal activity, or where an applicant is denied an immigration benefit and is unlawfully present in the United States.

“For too long, USCIS officers uncovering instances of fraudulent or criminal activity have been limited in their ability to help ensure U.S. immigration laws are faithfully executed. This updated policy equips USCIS officers with clear guidance they need and deserve to support the enforcement priorities established by the president, keep our communities safe, and protect the integrity of our immigration system from those seeking to exploit it,” said USCIS Director L. Francis Cissna.

Deferred Action for Childhood Arrivals (DACA) recipients and requestors are exempted from this updated guidance when: (1) processing an initial or renewal DACA request or DACA-related benefit request; or (2) processing a DACA recipient for possible termination of DACA. As explained in the concurrently issued DACA-specific guidance, USCIS will continue to apply the 2011 NTA guidance (PDF, 77 KB) to these cases. USCIS will also continue to follow the existing DACA information-sharing policy regarding any information provided by a DACA requestor in a DACA request or DACA-related benefit request.

USCIS, along with U.S. Immigration and Customs Enforcement (ICE) and U.S. Customs and Border Protection (CBP), has legal authority under current immigration laws to issue NTAs. This Policy Memorandum updates the guidelines USCIS officers use to determine when to refer a case to ICE or to issue an NTA. The revised policy generally requires USCIS to issue an NTA in the following categories of cases in which the individual is removable:

  • Cases where fraud or misrepresentation is substantiated, and/or where an applicant abused any program related to the receipt of public benefits. USCIS will issue an NTA even if the case is denied for reasons other than fraud.
  • Criminal cases where an applicant is convicted of or charged with a criminal offense, or has committed acts that are chargeable as a criminal offense, even if the criminal conduct was not the basis for the denial or the ground of removability. USCIS may refer cases involving serious criminal activity to ICE before adjudication of an immigration benefit request pending before USCIS without issuing an NTA.
  • Cases in which USCIS denies a Form N-400, Application for Naturalization, on good moral character grounds because of a criminal offense.
  • Cases in which, upon the denial of an application or petition, an applicant is unlawfully present in the United States.

The revised policy does not change the USCIS policy for issuing an NTA in the following categories:

  • Cases involving national security concerns;
  • Cases where issuing an NTA is required by statute or regulation;
  • Temporary Protected Status (TPS) cases, except where, after applying TPS regulatory provisions, a TPS denial or withdrawal results in an individual having no other lawful immigration status;
  • DACA recipients and requestors when: (1) processing an initial or renewal DACA request or DACA-related benefit request; or (2) processing a DACA recipient for possible termination of DACA.

Under separate policy guidance (PDF, 77 KB) issued concurrently, USCIS officers will continue to apply PM 602-0050, Revised Guidance for the Referral of Cases and Issuance of Notices to Appear (PDF, 77 KB) (NTAs) in Cases Involving Inadmissible and Removable Aliens, dated November 7, 2011, to the issuance of NTAs and Referrals to ICE for DACA recipients and requestors.

Interim and final policy memos are official USCIS policy documents and are effective the date the memos are issued.

USCIS to Celebrate Independence Day by Welcoming 14,000 New Citizens

WASHINGTON—This year, U.S. Citizenship and Immigration Services (USCIS) will celebrate the 242nd anniversary of the Declaration of Independence, and our nation’s birthday, by welcoming more than 14,000 new citizens in nearly 175 naturalization ceremonies between June 28 and July 10.

The Independence Day activities will kick off with a naturalization ceremony at the Bexar County Courthouse in San Antonio, Texas on June 28. During this event, USCIS Director L. Francis Cissna will deliver congratulatory remarks to 37 new Americans.

“The naturalization ceremony marks the end of the journey toward citizenship, just as it marks the start of new lives as American citizens,” said Director Cissna. “We are humbled to be able to share in this moment of pride, joy, and personal triumph.”

USCIS is committed to promoting awareness and understanding of citizenship by offering a variety of free citizenship preparation resources for applicants and teachers, including materials like the Establishing Independence (PDF, 2.41 MB)lesson plan in the Citizenship Resource Center. Immigrant-serving organizations can register to receive a free Civics and Citizenship Toolkit to help lawful permanent residents prepare for naturalization.

The importance of the Declaration of Independence and Independence Day in the United States is reflected in several places on the naturalization test. Prospective citizens may see them in six different questions on the civics test, including, “What did the Declaration of Independence do?” and “When do we celebrate Independence Day?”

To help applicants practice for the civics test, download the USCIS mobile app, USCIS: Civics Test Study Tools, which is currently available for download in the Google Play and iTunes stores. In addition to being the only official USCIS Civics Test application, the app keeps old tests for review, has a game to challenge your civics knowledge, and lists all 100 questions and answers that could be asked in the actual civics test.

High-Tech Features Create More Secure Documents

WASHINGTON — U.S. Citizenship and Immigration Services (USCIS) began issuing redesigned Certificates of Citizenship and Naturalization today, following a successful pilot in four USCIS field offices and one service center. The redesign of these eight certificates is one of the many ways USCIS is working to combat fraud and safeguard the legal immigration system.

We piloted the new certificate design at the Norfolk, Tampa, Minneapolis-St. Paul, and Sacramento Field Offices, as well as at the Nebraska Service Center.

The certificates of naturalization are:

  • N-550, issued to an individual who obtains U.S. citizenship through the naturalization process;
  • N-578, issued to a naturalized U.S. citizen to obtain recognition as a United States citizen by a foreign state; and
  • N-570, issued when the original Certificate of Naturalization is lost, mutilated, or contains errors.

A Certificate of Citizenship is issued to an individual who obtains U.S. citizenship other than through birth in the United States or through naturalization. The various types of Certificates of Citizenship are:

  • N-560A, issued to an applicant who derived citizenship after birth;
  • N-560AB, issued to an applicant who acquired citizenship at birth;
  • N-645 and N-645A, issued to the family of an individual who served honorably in the U.S. armed forces during a designated period of hostility and died as a result of injury or disease incurred in or aggravated by that service. Form N-645 is issued if the decedent was a male, and the N-645A if the decedent was a female.
  • Form N-561, issued to replace a Certificate of Citizenship when the original certificate is lost, mutilated, or contains errors.

The redesigned certificates of citizenship and naturalization feature a large, central image against a complex patterned background, which helps deter the alteration of personal data. Each certificate possesses a unique image only visible under ultraviolet light and attempts to alter it will be evident. Posthumous Certificates of Naturalization and the Special Certificate of Citizenship each bear a different image, yet feature the same fraud-deterrent security features.

Periodically changing the design and printing methods for these certificates helps USCIS stay a step ahead of counterfeiters.

Although the look and feel of the documents is new, the process of applying for and receiving them has not changed. Individuals do not need to renew their Certificates of Naturalization or Citizenship, regardless of when they were issued. The certificates we issued before the redesign will continue to be accepted as proof of citizenship.

Form I-751 Data Entry Delay at California Service Center

USCIS’ California Service Center (CSC) is experiencing a delay in initial data entry for Form I-751, Petition to Remove Conditions on Residence. Since initial data entry has to be completed before a receipt notice can be issued, some petitioners and their dependents may experience a delay in receiving a receipt notice for a Form I-751 submitted to the CSC.

If you submitted a Form I-751 to the CSC in May 2018 and you have not received a receipt notice, do not file a duplicate Form I-751 unless you have received a rejection notice or have been instructed to do so by the CSC.

The CSC is working to complete data entry of these petitions by the end of June 2018, and will issue another web alert once initial data entry has returned to normal. Petitioners will receive a receipt notice once their data is entered into USCIS systems.

We expect to issue most receipt notices by early July. If your 2-year green card has expired, you may schedule an INFOPASSappointment for you and any eligible dependents at your local field office. If possible, bring evidence that you sent your Form I-751 via USPS or courier service, such as FedEx. If you have any questions about the process,  you may reach out to the USCIS Contact Center.

DHS Announces Additional Visas for Foreign Workers to Assist American Businesses at Risk of Failing

WASHINGTON — Today, Secretary of Homeland Security Kirstjen M. Nielsen announced that an additional 15,000 H-2B temporary nonagricultural worker visas will be available for Fiscal Year 2018. In this determination, Secretary Nielsen determined there are not sufficient, qualified, U.S. workers available to perform temporary non-agriculture labor to satisfy the needs of American businesses in FY18. This allocation is in addition to the 66,000 visas already issued this year. Secretary Nielsen made this decision after consulting with Secretary of Labor Alexander Acosta, members of Congress, and business owners.

“The limitations on H-2B visas were originally meant to protect American workers, but when we enter a situation where the program unintentionally harms American businesses it needs to be reformed,” said Secretary Nielsen. “I call on Congress to pass much needed reforms of the program and to expressly set the number of H-2B visas in statute.  We are once again in a situation where Congress has passed the buck and turned a decision over to DHS that would be better situated with Congress, who knows the needs of the program.  As Secretary, I remain committed to protecting U.S. workers and strengthening the integrity of our lawful immigration system and look forward to working with Congress to do so.”

The H-2B temporary nonagricultural worker program was designed to serve U.S. businesses unable to find a sufficient number of qualified U.S. workers to perform nonagricultural work of a temporary nature. Congress set the annual H-2B visa cap at 66,000. A maximum of 33,000 H-2B visas are available during the first half of the fiscal year, and the remainder, including any unused H-2B visas from the first half of that fiscal year, is available starting April 1 through September 30.

On February 27, 2018, USCIS determined that it had received sufficient H-2B petitions to meet the full FY 2018 statutory cap of 66,000.

In the FY 2018 Omnibus, Congress delegated its authority to the Secretary to increase the number of temporary nonagricultural worker visas available to U.S. employers through September 30, just as it did in the FY 2017 Omnibus. In the intervening time since enactment of the FY 2018 Omnibus, the Secretary consulted with the Secretary of Labor on the issue, in accordance with Congressional requirements, and developed this rule.

Starting this week, eligible petitioners for H-2B visas can file Form I-129, Petition for a Nonimmigrant Worker.  Eligible petitioners must submit a supplemental attestation on Form ETA 9142-B-CAA-2 with their petition.

Details on eligibility and filing requirements will be available in the final temporary rule and on the Increase in H-2B Nonimmigrant Visas for FY 2018 webpage to be published on uscis.gov when the final temporary rule is posted for public inspection.
